NOTICE OF SALE UNDER POWER STATE OF GEORGIA COUNTY OF THOMAS Under and by virtue of the Power of Sale contained in a Security Deed given by DOROTHY MAUNEY HOWARD to Bank of America, N.A. dated December 3, 2010 and recorded on December 30, 2010 in Deed Book 1676, Page 329, of the Thomas County, Georgia records, as last assigned to WILMINGTON SAVINGS FUND SOCIETY, FSB, NOT IN ITS INDIVIDUAL CAPACITY BUT SOLELY AS TRUSTEE OF HECMRESI TRUST 2023-1 (the Secured Creditor), by assignment, conveying the after-described property to secure a Note of even date in the original principal amount of $202,500.00, with interest at the rate specified therein, there will be sold by the undersigned at public outcry to the highest bidder for cash in Thomas County, before the Courthouse door, or at such place as may be lawfully designated as an alternate, and within the legal hours of sale on July 02, 2024, being the first Tuesday in July 2024, the following described property: ALL THAT TRACT OR PARCEL OF LAND SITUATE, LYING AND BEING IN THE 13TH LAND DISTRICT OF THOMAS COUNTY, GEORGIA, AND BEING LOT 8 OF INWOOD PLANTATION AS SHOWN BY A PLAT OF SURVEY PREPARED BY FRANK E. CARLTON, GEORGIA REGISTERED LAND SURVEYOR NO. 1544, DATED OCTOBER 25, 1977, AND RECORDED IN PLAT BOOK 4, PAGE 8, AMONG THE DEED RECORDS OF THOMAS COUNTY, GEORGIA, TO WHICH REFERENCE IS MADE FOR A MORE PARTICULAR DESCRIPTION. THIS CONVEYANCE IS MADE SUBJECT TO THOSE RESTRICTIONS OF RECORD AS CONTAINED IN A WARRANTY DEED DATED JANUARY 27, 1978, AND RECORDED IN DEED BOOK 112, PAGE 152, IN THE OFFICE OF THE CLERK OF SUPERIOR COURT OF THOMAS COUNTY, GEORGIA. Property Address: 169 Acacia Blvd, Thomasville, GA 31792 (the Property). The debt secured by said Security Deed has been and is hereby declared due because of, among other possible events of default, failure to pay the indebtedness as and when due and in the manner provided in the Note and Security Deed. Because the debt remains in default, this sale will be made for the purpose of paying the same and all expenses of this sale, as provided in the Security Deed and by law, including attorneys fees (notice of intent to collect attorneys fees having been given). Secured Creditor is the current assignee of the Security Deed to the Property.
