NOTICE OF SALE GEORGIA, THOMAS COUNTY. WHEREAS, heretofore on April 21, 2022 SHANNON C. BLACK did execute to THOMASVILLE NATIONAL BANK a certain Security Deed to the following land: UNIT 8 of Condominium Unit Area 2 of the Condominium at Jamestowne, a Georgia condominium pursuant to the Georgia Condominium Act and pursuant to the First Amended and Restated Declaration of Condominium for the Condominium At Jamestowne dated August 11, 2009 (the Declaration), recorded at Deed Book 1587, page216, Office of the Clerk of the Superior Court of Thomas County, Georgia, having a current street address of 111 Butterfield Street, Thomasville, Thomas County, Georgia 31757 respectively, together with the undivided interest in the common elements and any limited common elements appertaining TO SAID Unit as specified in the Declaration, together with all rights and privileges appertaining thereto and subject thereto all the provisions of the Declaration. Said Units are further defined and depicted according to the Architectural Plans which are attached to and incorporated into the Declaration and according to the Certified Drawings which identify and certify the accuracy of the final dimensions of the completed structure(s) comprising the Unit, recorded in Condominium Plat Book C2, Folio 44-53 among the deed records of Thomas County, Georgia. The Condominium is located on the property identified according to the Condominium Plat of survey titled A FINAL PLAT OF SURVEY OF: THE CONDOMINIUM AT JAMESTOWNE prepared by Cary B. Wetherington, Georgia Registered Land Surveyor No. 2899, dated March 9, 2009 and recorded April 1, 2009 in Plat Cabinet 5, Folio 37A, 37B, and 38A among the Public Records of Thomas County, Georgia. Reference to Architectural Plans, Certified Drawings and Condominium Plat are made for a more particular description as set forth therein. (the Property). The Property is located in Land Lot 101 of the 13th Land District of Thomas County, Georgia (Land Lot No. 101 having been transposed with Land Lot No. 130 by scriveners error on the above referenced Plat of Survey). The Property has on it improvements known as 111 Butterfield Street, Thomasville, Thomas County, Georgia 31757, also known as Map Parcel 45S-206A, according to the addressing system currently used by Thomas County, Georgia. Also conveyed hereby for each Unit is a 3.574% undivided ownership interest in the Common Elements, which respective interest shall not be conveyed, transferred, encumbered or otherwise affected from the ownership of each Unit. The Property is conveyed subject to the declarations described in that Warranty Deed from Sara L. Gilreath n/k/a Sara Whitehurst to Williams Property Holdings, LLC dated October 16, 2014 and recorded in Deed Book 1926, page 229 among the deed records of Thomas County, Georgia. The above described property is identified as 111 Butterfield Street, Thomas County, Georgia 31757 and Tax Parcel No. 045S 206A. WHEREAS, said Security Deed secures a Promissory Note dated April 21, 2022 in the original principal amount of ONE HUNDRED NINETEEN THOUSAND NINE HUNDRED AND NO/100 DOLLARS ($119,900.00) and all other indebtedness then owing or thereafter arising between the parties, all shown by a Security Deed recorded in Deed Book 2477, Pages 170-178 among the Deed Records of Thomas County, Georgia. WHEREAS, Thomasville National Bank is the holder of the Note and Security Deed; and WHEREAS, payments under the Note have become in default, and the default continues, and the undersigned has elected that the entire debt, principal and interest, become due at once as provided in the Note and Security Deed, and the undersigned has elected to proceed with foreclosure under its Security Deed. NOW, THEREFORE, according to the original terms of said Security Deed and pursuant to the power of sale contained therein and the laws in such cases made and provided, the undersigned will expose for sale to the highest and best bidder for cash the above described property, after proper advertisement, on the first Tuesday in July, 2024, being July 2, 2024, between the legal hours of sale before the Thomas County Judicial Center, 325 N. Madison Street, Thomasville, Georgia 31792. Said property will be sold subject to taxes for the year 2024 and any prior unpaid taxes, any matters which might be disclosed by an accurate survey and inspection of the property, any assessments, liens, encumbrances, zoning ordinances, restrictions, covenants and matters of record superior to the security deed first set out above. The proceeds from said sale will be used, first to the payment of said debt, principal, interest and expenses and attorneys fees for which proper notice is given, and the balance, if any, delivered as provided in said Security Deed.
