NOTICE OF SALE GEORGIA, THOMAS COUNTY. WHEREAS, heretofore on July 16, 2014 Ira J. Peterson and Lougenia Scott did execute to EAGH, LLC a certain security deed to the following land: All that tract or parcel of land situate, lying and being in Land Lot 38 in the 13th Land District of Thomas County, Georgia, identified as Lot 24 of Woodland Heights as shown on that plat of survey prepared by Cary B. Wetherington, Georgia Registered Land Surveyor No. 2899, December 21, 2007 and revised April 14, 2010 and recorded in Plat Cabinet 5, Folio 61-D among the Deed Records of Thomas County, Georgia. The above described property is identified as 106 Fern Grove Court, Thomasville, Thomas County, Georgia 31792 and Tax Parcel No. 013 007124. The above-described property is subject to a debt owed by EAGH, LLC to Thomasville National Bank secured by a Security Deed from EAGH, LLC to Thomasville National Bank dated February 23, 2010 recorded in Deed Book 1621, Pages 223-227 of the Deed Records of Thomas County, Georgia, which debt EAGH, LLC is obligated to pay. WHEREAS, the security deed from Ira J. Peterson and Lougenia Scott secures a Promissory Note from Ira J. Peterson and Lougenia Scott to EAGH, LLC dated July 16, 2014 and all other indebtedness then owing or thereafter arising between the parties, all shown by a security deed recorded in Deed Book 1918, Pages 363-369 of the Deed Records of Thomas County, Georgia; and WHEREAS, This is the second foreclosure of the security deed recorded in Deed Book 1918, Pages 363-369 occasioned by a ruling in Thomas County Superior Court Civil Action SUCV2022000315, which ruling intimated that the previous foreclosure was not valid. The previous foreclosure deed is recorded in Deed Book 2236, Pages 389-391 of the Deed Records of Thomas County, Georgia. The Grantee who purchased the property at the previous foreclosure sale was EAGH, LLC; and WHEREAS, Lougenia Scott conveyed her interest in the subject property to Ira J. Peterson by execution of a quit claim deed dated November 20, 2014 recorded in Deed Book 1935, Pages 409-410; and EAGH, LLC is the secured party and holder of the Note and Security Deed recorded in Deed Book 1918, Pages 363-369 of the Deed Records of Thomas County, Georgia. WHEREAS, payments under the Note were delinquent more than 120 days, and a default occurred under the terms of the note and security deed. All notices required in the loan documents have been given, as required, and the undersigned has elected to proceed with non-judicial foreclosure as provided for in said security deed. NOW, THEREFORE, according to the original terms of said security deed and pursuant to the power of sale contained therein and the laws in such cases made and provided, the undersigned will expose for sale to the highest and best bidder for cash the above described property, after proper advertisement, on the first Tuesday in June 2024, being June 4, 2024, between the legal hours of sale before the Thomas County Judicial Center, 325 North Madison Street, Thomasville, Thomas County, Georgia. Said property will be sold subject to taxes for the year 2024 and any prior unpaid taxes, any matters which might be disclosed by an accurate survey and inspection of the property, any assessments, liens, encumbrances, zoning ordinances, restrictions, covenants and matters of record superior to the security deed first set out above. The proceeds from said sale will be used, first to the payment of said debt, principal, interest and expenses and attorneys fees for which proper notice is given, and the balance, if any, delivered as provided in said security deed.
